As of today we have heard absolutely nothing from the Mortgage Company, still waiting!!

Do you think we need to do anymore, or just sit and wait it out?

Hello Soozysoo

You have proved to be problematic to the debt collector in that you want some hard facts, nothing unusual in my book, and this is something they have to produce. I still stand by my belief that the debt collector does not actually have the information you are requesting, at present, but they may well obtain this in the future.

I know you would dearly love to get rid of this debt and settle amicably but how can you if the debt collector/agent/ or mortgage lender cannot supply a statement about the debt?

So it's either sit it out and do nothing or make contact with an offer in full and final settlement in the New Year. I went through the thread and note the suggested opening offer would be circa £2,500, is this possible?

Good Morning Mike

First off welcome back online.

So, since our last post at the end of December 2015, nothing further was heard from the 'Woolwich mortgages from Barclays', nothing in 2016, until a letter arrived at the end of May 2017 from 'Barclays'!!

They are again chasing the shortfall of just over £16,000 from my brother, he has still not received the Asset Statement / Shortfall Breakdown, despite asking on numerous occasions for it.

I was able to speak to them in 2014 / 2015, but when I phoned to discuss on his behalf they now have no record of being able to talk to me, it has just been an utter nightmare from start to finish.

This is now been going on since January 2010, when he separated from his wife, the mortgage was paid for some time after while she was still in the house, it was repossessed in September 2011, and then sold in March 2012.

So as you can see he has had this hanging over him for a number of years and still not received any answers.

At the beginning of June he has put in a formal 'Subject Access Request' as suggested, but I understand this can take up to 40 days.

I just thought I would update you on the situation and hopefully he may finally get some answers and therefore some closure.

Thanks for the update, the mortgage lender, like any other company, must respond to the 'Subject Access Request Notice' SARN, and it from here that you might start getting some answers.

Further to my earlier post, we hadn't received anything until the post arrived this morning, another letter from Barclays, reference the shortfall referring to our letter of the 19th May 2017. They attach a letter dated the 26th June 2012, saying this is the breakdown, we had seen this before!!.

The point is not once in this letter does it quote the shortfall balance of £16,000, it states the last payment made on the account was December 2010, when we know from court papers it was much later, it gives a % rate for interest charged but no amount, all very confusing, as to how the shortfall is made up.

As said previously my brother put in a Subject Access Request on the 02nd June 2017, not heard anything as of yet.

Not sure where to go from here.

Hello Soozysoo

You could write back to Barclays saying they have not provided adequate information as requested in your earlier letter, enclose a copy, and say that if they do not provide the information then you will registered a complaint with them and go to the Financial Ombudsman Service (FOS) for further assistance.

Failing that you could wait until you receive a response to the SARN sent on 2 June 2017, from memory I believe they have six weeks to respond.The SARN may give you all the information you are looking for, but in my book I would still write back as per my first paragraph on this post. I am beginning to suspect the employee at Barclays does not have all the information to hand and needs to do a lot more work!

Hello Mike

Further to your earlier reply, on Saturday the Subject Access Request Paperwork arrived, we asked for all loans and mortgages against my brothers name, we also thought it was a good opportunity to check if there was any other PPI on anything that we hadn't previously claimed back.

So the pack included the loan he had with Barclays which had been settled some years ago, and also the PPI claim he made, and recovered a decent sum of money from. So all good on that front.

The biggest surprise was that there is nothing at all about the mortgage, no mention whatsoever!!

Would it of made any difference that the mortgage would of been in joint names at the time??

As you suggested we will write to the mortgage company again, should we raise the question about it also with the department which would of sent out the Subject Access information?
