Intelligent Finance Charges for Renting Out House

Hi

I rented out my house 3 years ago when I could no longer afford to live in it. IF are charging me an unauthorised letting fee of £2000 every 6 months. As it is my rent just covers the mortgage and so my overall indebtedness is going up annually. I have written to them and asked them to wipe this charge but they refuse. I also asked them if they would accept a reduced settlement if I remortgaged and they just didn't answer me.

It is a residential mortgage and I understand that they can charge what they like but surely they have a duty to ensure my debt doesn't increase needlessly?

Any suggestions would be much appreciated.

Hello mikeh and a very warm welcome to the DebtWizard IVA and debt help forum.

I note from your post that you do not have a buy to let mortgage and that the mortgage lender is now invoking a penalty. If you have not already done so then I would revisit the lender's T&Cs to see they they are acting within those terms. Mortgage T&Cs are not my field but I can refer you to a more legal forum if you wish.

I also note that you say the mortgage lender has not responded to your communications, this is grounds for you to speak with the Financial Ombudsman Service (FOS)

The Financial Ombudsman Service (FOS) is as official independent body in settling complaints between consumers and businesses providing financial services.

Consumer helpline open 8am to 8pm, Monday to Friday, Saturday 9 to 1pm

I have sent them this week a recorded delivery letter which I know they have received. I've given them 14 days to respond.
