Hi Mike sorry for taking my time getting back to you. Well things have certainly changed since we last spoke.

I took some legal advice and their advice was that seeing as the children now lived with me why don’t I ask the court to set aside the previous order giving her the house (that she still hasn’t paid mortgage on for 11 months) and get it re done.

Well after a huge fight and many visits to court and with the help of an amazing (cheap) barrister last week the court set the previous order aside as it was inchoate and there were massive changes in circumstances and the main root of the order was to keep the children in their home.

The judge didn’t take well that she had black listed my name and this will be taken into account and a % of the matrimonial pot will be given to me as recompense for this when he re does the order he will also take into account the fact I paid the joint IVA by myself with no help from her and again deduct the amount from her share.

Also the house will be given to me on the same grounds as it was her. I have with the judges blessing started to pay the mortgage already in order to maintain the asset that would have been repossessed if I hadn’t.

I have spoken to the mortgage company and after I’ve made12 payments on time they will capitalise the debt she has built up so hopefully there is now light at the end of the tunnel.

Thanks for the update, I always do wonder how folks get on after posting on the forum.

Sounds like you have a right result. Where did you find the 'cheap' barrister? Obviously paid dividends for you.

Just goes to prove that if you are determined and driven you can get results so a huge well done you. :D

All I can offer is knuckle down with the payments and check your credit file again in a few months time to see how that's looking and pop back if you need anymore help.

Hi Mike

Cheap Barrister was from a site called direct access barristers, you can get a barrister without having to go through a solicitor. So I was offered an hours consultation with a Barrister through my solicitor for £500.

So I went on line got a direct access Barrister with 25 years experience and whole job including helping with applications and an afternoon in court for £600 plus vat.

One more day in court mid April to finalise things then hopefully a massive problem on its way to being gone.

It would be really helpful if you could copy and paste the link for the website you found the barrister in the pm and send it to me. I did a search and there seems to be a few links but want to get the right one.

My thinking is I could add this to the forum for the benefit of others that find themselves in a similar position plus also be a useful source should I need to help someone looking for that level of representation at court.
