Unjust Default Notice- please help.

Hi,

I am trying to get to the bottom of a default notice I have discovered on my partner's credit history. Lowell finance registered a default on a debt of £13 in relation to a debt owed to Orange several years previously. At no time did Orange write to inform that this would be passed to a debt collectors or was on the verge of default and at no time did Lowell write to us to warn us o the default.

We paid the sum immediately upon finding out about it but it feels like surely there must be something we can do given the fact that nobody told us there was a debt and it's such a nominal fee!

I have already written once to Lowell who just batted it back by saying that they've made a note on the credit file that we have settled the debt.

Any advice would be very much appreciated as we're trying to buy a house.

Hello nichall and a very warm welcome to the DebtWizard IVA and debt help forum.

You could ask the debt collectors to remove the default notice on the grounds the debt is now clear and your partner was never informed of the outstanding money allegedly owed, if they agree it will need to be on their headed paper and sent to you for confirmation, this you will then sent onto a credit reference agency (CRA).

Thanks Mike, very much appreciate that. If they refuse, do I have any means of recourse against them, given the absence of a warning of default?

You could have a word with the Financial Ombudsman Service (FOS) they are free to consumers, more here
