Dear Mike

It appears my brother phoned the mobile number on the letter from Fieldcall, and had a conversation with them, he told them that despite writing to the mortgage company on a number of occasions he has never been able to obtain a complete breakdown of the shortfall.

He also mentioned that it was a joint mortgage with his soon to be ex wife, the agent has no record of this and on the face of it, it appears that they have been solely chasing my brother for the debt!!

No appointment to visit has been arranged and the Fieldcall agent said he would look into it and get back to my brother, he said it may take a week or so though.

Hello soozysoo

No matter what the Field agent says, your brother's ex wife will be pursued for the debt at some stage, remember the mortgage lender has twelve years from the date of the last payment or acknowledgement in writing on the account, by either named person.

So if your brother successfully brokers a deal in full and final settlement the time clock for the ex wife will 'restart' the day he makes a payment.

Dear Mike

Since my last post back in March 2014, we have heard very little from the mortgage company, despite still trying to obtain a complete breakdown of the shortfall. The last contact we had with them was back at the end of June 2014, when they said they would locate the file and send out the asset statement / breakdown we never received anything!!

Then today a letter is received chasing the amount of £16,000 + in fact it has gone up £24 for some reason, still no calculation as to how the shortfall came about.

The house was repossessed in September 2011, my brother hadn't lived in the property since January 2010, his now ex wife still resided there until this date. The house was then sold in March 2012, since that date he has been trying to obtain the information, this was a joint mortgage.

Please could you advise the best way to resolve this issue, I was planning to call them on Monday to ask for the information again.

Hello Soozysoo and welcome back to the forum.

I note in one of tour earlier posts Mar 2014
If they do not receive a proposal by the 01st March 2014, they will instruct solicitors to start action in the County Court.

Obviously bluffing because if they were serious they would have followed this up.

I would write again to the debt collector/agent/mortgage lender and request a complete breakdown of the debt and explain that this matter cannot continue until you have an opportunity to examine how they have calculated the debt.

You will be looking for a breakdown covering the amount of interest, the capital sum and fees plus legals. You also want to know if the Mortgage Indemnity Insurance (MIG) has claim against your brother separate to this claim.

If the recipient of your letter, posted by recorded delivery and track, fails to comply then you will register a complaint and then go to The Financial Ombudsman Service (FOS).

I know you want to settle this but how can you if the debt collector/agent/ or mortgage lender cannot supply a statement about the debt?

Many Thanks for your reply, as suggested we will write again to the Mortgage Company requesting the calculation, and then it is just a waiting game!!

The current letter says they have to receive a proposal by the 28th October 2015, looking at previous letters this just appears to be one of their standard letters they send out.

In the letter we send should it just be about the shortfall or should we make any reference to making a complaint and the Financial Ombudsman.

I would mention both. Agree, a waiting game.

It may well transpire that the debt collector does not actually have the information you are requesting which is why they are unable to back up any of their threats.

Still Waiting!!

The letter was posted by recorded delivery on the 21st October 2015, to the Mortgage company, and it was signed for on the morning of the 22nd October 2015, I have printed off the receipt from the Royal Mail website, to confirm this.

As of the 03rd November 2015 (Today) we have received nothing from them. I will keep you updated if we hear anything.

Hello Soozysoo

As I suspected, but is is still early days since you last posted that letter.

Don't be surprised to receive new contact at some time in the future from a different debt collector, just a hunch I have.

If you are problematic and request information the debt collector does not have, and they bought the debt cheaply, then often it is 'sold on' and the saga repeats itself.

Just ensure you keep all your paperwork and sit it out.
